Esta obra perteneció al coleccionista Luis Navas. Posteriormente salió de España y estuvo en varias colecciones extranjeras: la de Wasserman, en Munich; la de Bossard, en Lucerna; la de Robert Neugebauer, en Colonia; y finalmente estuvo en otra colección privada en Zurich. Posteriormente fue adquirida por el Instituto Aino Gakuin de Osaka, Japón, y llevada al Museo Nacional de Arte Occidental, en Tokio.
Juan Martín Díaz, conocido como El Empecinado (Castrillo de Duero, Valladolid, 1775-Roa, Burgos, 1825) fue un guerrillero español que luchó contra los franceses en la Guerra de la Independencia.
El trasiego de este retrato por numerosas colecciones extranjeras ha dificultado el estudio de la obra, y por ello ha sido excluido de algunos de los catálogos más importantes de la obra de Goya. Pero con el paso del tiempo ha sido rescatada del anonimato y actualmente es considerada por la mayoría de los especialistas como una obra original de Goya. Casi todos los expertos fechan esta obra en los años de la contienda armada contra las fuerzas francesas, como sugiere el carácter militar de la obra y la propia biografía de su modelo, pero fue Arturo Ansón quien pudo fecharla con precisión en el año 1809.

Castrillo de Duero is a small town in Valladolid with barely 150 inhabitants. Despite its tiny size, it has several interesting buildings, such as the parish church or several emblazoned houses. The reason for my presence, however, is not touristy: I follow the trail of the guerrilla Juan Martín Díez, better known as El Empecinado, a popular leader born here. A statue of him presides over the Plaza Mayor. I also find the headquarters of the Círculo Cultural Juan Martín el Empecinado, created by volunteers, willing to rescue their neighbor from oblivion with more enthusiasm than means.
When history repeated itself in Medina de Rioseco, Juan Martin understood the unfeasibility of facing the French in the open field, as equals. He and his men abandoned the army and devoted themselves once again to guerrilla action. Their objective would be to harass the communications and supplies of the French army by intercepting mails and messages, and capturing convoys of supplies, money or weapons.

Juan Martín Díez, “El Empecinado”, was born on September 2, 1775 in Castrillo de Duero (Valladolid). Son of a prosperous farmer, he was a farmer (today his house is preserved in his town). His baptismal certificate is in the Diocesan Archives of Valladolid, and reads as follows:
The natives of Castrillo were called with the nickname of “empecinados”, because of a stream, called Botijas, full of pecina (the green silt of decomposing waters) that crosses the town and it is believed that this is where the nickname comes from for this character.
In 1812, after leaving Brihuega (Guadalajara) he moved to Torija (Guadalajara) and decided to blow up the castle of Torija so that the French troops could not make themselves strong in the enclosure. Torija Castle
Apparently, King Ferdinand VII tried to get the Empecinado to join his cause (in spite of having previously sworn the Constitution of Cadiz) and join the “Hundred Thousand Sons of St. Louis”; he offered to grant him a noble title and a large amount of money, one million reales. [1] The response of the Empecinado was: “Tell the king that if he did not want the constitution, he should not have sworn it; that the Empecinado swore it and will never commit the infamy of failing to keep his oaths.”[2]
